Program Goals
To minimize health risks to the public and potential environmental damage by ensuring that plans for water supply, sewage disposal, and erosion/siltation control for proposed developments in Monroe County meet established standards.
There are two (2) types of subdivision proposals that require the review and approval of the Monroe County Department of Health:
- Proposed subdivisions that meet the New York State definition of a realty subdivision (See Appendix A). For all such subdivisions the Department of Health must review and approve plans for both public and private water supply and sewage disposal facilities.
- Proposed subdivisions which have the following characteristics:
- They do not meet the New York State definition of a subdivision (Appendix A);
- but do meet the definition under which the municipal planning board reviews subdivisions (Appendix B); and
- the proposed subdivision will be served by on-site sewage disposal systems.
For all such subdivisions the Department of Health must approve of the on-site sewage disposal systems, but not the proposed water supply systems. The Department of Health will, however, review the water supply systems and issue recommendations.
Legal Authority
Articles IIA and III of the Monroe County Sanitary Code, Sections 1150-1120 of the New York State Public Health Law, and Article 17, Sections 501-1515 of the New York State Environmental Conservation Law.
Program Highlights
- Review and approve plans and specifications following the latest editions of “Recommended Standards For Water Works and Wastewater Facilities” (Ten States Standards) and the MCDOH’s Individual Sewage Disposal Manual.
- Review arrangements for erosion/siltation control during all phases of construction and evaluate other environmental concerns.
- Respond to and conduct complaint investigations.
- Issue Approvals of Completed Works for water system improvements.
- Consult with the applicant, design engineer, county and municipal officials, the New York State Departments of Health and Environmental Conservation, and the public.
- Perform enforcement actions pursuant to Articles IIA and III, Title I, Section 309(f) of the Public Health Law.
Application Procedure
Application is made by submitting a completed “SAN-72 Form”. If a subdivision requires the construction and/or extension of a water main or sewer line then the applicant must also complete a “DOH-348 Form” for water mains and a “BSP-5 Form” and “SAN 65 Form” for sewer lines. Copies of these forms are available on this web site or from the Monroe County Department of Health, Bureau of Public Health Engineering, Individual Sewage Treatment and Disposal Section, Room 938, 111 Westfall Road PO Box 92832, Rochester, New York 14692. One (1) copy of the completed form must be submitted to the Department of Health along with one (1) set of subdivision plans. The set of subdivision plans must be prepared by a licensed professional engineer, exempt land surveyor, or architect and may be the same as that submitted for municipal planning board approval.

Subdivisions on Public Utilities: $90 per Lot.
Subdivisions on Individual Sewage Disposal Systems: $310 first Lot.
Subdivisions on Individual Sewage Disposal Systems: $220 each additional Lot.

Program Goals
To assure that the proposed sewer line will meet environmental and public health standards for sewage disposal by reviewing and approving all plans for the construction or extension of public sewer lines within Monroe County.
Legal Authority
Section 17-0303 of the New York State Environmental Conservation Law, Title 6, Part 652 of the New York State Codes, Rules, and Regulations.
Program Highlights
- Review and approve plans and specifications following the latest edition of the “Recommended Standards For Wastewater Facilities” (Ten States Standards) and the NYSDEC’s Technical & Operational.
- Guidance Series (TOGS) and Technical Informational Pamphlets (TIPS).
- Consult with the applicant, design engineer, county and municipal officials, the New York State Departments of Health and Environmental Conservation, and the public.
- Respond to and conduct complaint investigations.
Application Procedure
Application is made by submitting a completed “BSP-5 Form” and “SAN-65 Form”. Copies of these forms are available on this web site or from the Monroe County Department of Health, Bureau of Public Health Engineering, Individual Sewage Treatment and Disposal Section, Room 938, 111 Westfall Road PO Box 92832, Rochester, New York 14692. One (1) copy of each completed form should be submitted to the Department of Health along with one (1) copy of the sewer plan as prepared by a licensed professional engineer.
Application Fee(s)
New Sewer or Sewer Extension: $210.
Other Mandated Permits and Reviews
Certain plans for the construction or extension of sewer lines require approval of the Monroe County Pure Waters, others require the approval of the local municipality. Additional permits from the New York State Department of Environmental Conservation and United States Army Corp of Engineers may also be required.
Additional Information
The Monroe County Department of Health, in its review of subdivision applications, may require a public sewer connection or extension if the development is to be located in or near an existing sewer service area.
The Department of Health will not issue its final approval of sewer plans until they have been approved by the Monroe County Pure Waters or by the local municipality that owns the utility.

Commercial On-Site Sewage Disposal Systems

Program Goals
To minimize health risks to the public and potential contamination of surface and ground waters by ensuring that non-residential on-site sewage treatment systems are designed, constructed, maintained, altered, or repaired in accordance with established standards.
Legal Authority
Article 17 of the New York State Environmental Conservation Law, Article II-A of the Monroe County Sanitary Code.
Program Highlights
- Review and approve plans and specifications following NYSDEC and MCDOH design standards.
- Review the proposed NYSDEC State Pollution Discharge Elimination System (SPDES) permit.
- Consult with the applicant, design engineer, county and municipal officials, the New York State Departments of Health and Environmental Conservation, and the public.
- Conduct site and construction inspections.
- Perform surveillance sampling to meet SPDES permit effluent limits.
- Respond to and conduct complaint investigations.
- Take enforcement action pursuant to Article III, Title I, Section 309 (f) of the Public Health Law.
Application Procedure
Application is made by completing the “BSP-5 Form” for surface discharges and a “C SUB 2002 Form” for subsurface discharges. Copies of these forms are available from the Monroe County Department of Health, Bureau of Public Health Engineering, Individual Sewage Treatment and Disposal Section, 111 Westfall Road PO Box 92832, Rochester, New York 14692. One (1) copy of the completed form must be submitted to the Department of Health along with the following:
- One (1) copy of the engineering and design report.
- One (1) copy of the proposed plans and specifications prepared by a licensed professional engineer, exempt land surveyor, or architect.
The application must be accompanied by a form, completed by the municipal building inspector, that provides general site information. Additionally, the application requires that percolation and deep-hole tests be taken on-site and witnessed by the Department of Health.

Other Mandated Permits and Reviews
Non-residential on-site sewage disposal systems with flows greater than 1000 gallons per day require a NYSDEC State Pollution Discharge Elimination System (SPDES) permit.
Other Information
Where the proposed development is in or near an existing sewer system service area, the Department of Health may require the development to be served by the existing sewer system rather than by an on-site sewage disposal system.
